BOOKING & CANCELLATION POLICY: DAILY TRAIL RIDES

A deposit of 20% of the ride cost is required to secure a booking.
0 to 30 days prior to booking full payment is required.
The following charges will be incurred.
Postponement of a booking, with more than 24 hours notice
– 15% Administration fee.
Cancellation with more than 48 hours notice
– 50% of ride cost.
Cancellation with less than 48 hours notice
– 100% of ride cost.
The above is relevant to gift voucher bookings as well

BOOKING & CANCELLATION POLICY: TOURS, CLINICS, WEEKEND PACKAGES & ACCOMMODATION

A 20% deposit of total cost is required to secure your booking. Balance due 30 days prior to departure.
The following charges will be incurred.
Postponement more than 30 days prior to departure
– 10% Administration fee.
Cancellation with more than 30 days prior to departure
– 100% of Deposit.
Cancellation 29 to 0 days prior to departure
– 100% of tour cost.
The above is relevant to gift voucher bookings as well

CHANGE OF ITINERARY

Most of our adventures are in remote wilderness areas and Bogong Horseback Adventures reserves the right to alter itineraries as weather and conditions demand. Any personal expenses incurred as a result of delays, alterations or curtailments on any Adventures caused by such circumstances are your responsibility. Bogong Horseback Adventures reserve the right to alter all prices and itineraries without notice.

GIFT VOUCHERS

Gift vouchers will be extended from their written due date on discretion, and only if requested prior to the expiry date.
Gift Vouchers are strictly non-refundable.

INSURANCE

Bogong Horseback Adventures recommend all clients take out travel insurance and that, in so doing, you check that your policy covers the appropriate activity and emergency evacuation charges. Bogong Horseback Adventures recommend all domestic riders have their state or territory ambulance cover, and international riders have appropriate travel insurance cover.

WEIGHT RESTRICTIONS

Bogong Horseback Adventures has a maximum weight limit of 95kg for all horse riding activities. If you exceed 95kg Bogong Horseback Adventures may consider a special exception if your height to weight ratio meets our requirements, contact our office to discuss this further. If you do not meet our weight limit policy we reserve the right to cancel your booking with no refund.

MINIMUM NUMBERS

All rides are subject to minimum numbers.

RELEASE AND WAIVER OF LIABILITY


WARNING: Horse riding is a Dangerous Activity. By signing this form you give up the right to sue. Refer to the WARNING UNDER THE FAIR TRADING ACT 1999 below.
TO: Spring Spur Pty. Ltd.
Trading as Bogong Horseback Adventures (hereinafter called Bogong Horseback Adventures)
TO: The various Land Management Authorities who grant the License to operate this adventure trip
or activity, being the Licensor.
IN CONSIDERATION of Bogong Horseback Adventures accepting my application for, and my being permitted to participate in the proposed activity on the land owned by the Licensor or elsewhere. I agree to this release of claims, waiver of liability and assumption of risk (collectively, this Agreement), including without limitation, negligence on the part of Bogong Horseback Adventures, its Staff, or the Licensor.
I WAIVE any and all claims I may now and in the future have against, and release from all liability and agree not to sue Bogong Horseback Adventures, its officers, employees, guides, principle agent, other agents or representatives (collectively, its Staff) or the Licensor for any personal injury, death, property damage, or other physical, mental or economic loss sustained by me as a result of my participation in a proposed activity with Bogong Horseback Adventures due to any cause whatsoever.
I ACCEPT all the inherent risks of the proposed activity and possibility of personal injury, death, property damage or other physical, mental or economic loss resulting therefrom.
I AM AWARE that the proposed activity, in addition to usual dangers and risk inherent, has certain additional dangers and risks, some of which may include, but not limited to:
 The unpredictability of horses, however well-trained and normally docile they may be – Competitive behavior such as lunging, biting and kicking at other horses without regard for nearby humans, caused by proximity of another horse or competition for feed – Rushing at food,
or through narrow openings such as gateways – Sudden lifting or swinging of head – Horse standing on handlers foot – Unpredictable movements – Sharp and jarring movements – Shying and taking fright, ‘flee from fear’ response common to all horses- Loss of balance(rider)
- Falling from horse – Dragged by stirrup – Struck by another horse after falling -Dropped reins – Rider panic causing imbalance or fear in horse – Horse falling over – Reckless behavior of other riders – Physical exertion for which I may not be prepared – Campfires – Uneven ground – Sharp sticks, puncture and eye injuries – Falling timber striking rider or causing horse ‘flee from fear’ response, – Loose rocks, 
falling or scaring horses – Unstable tracks and routes – Other track users such as motorbikes, 4WD, dogs, wildlife, feral animals – Weed and vermin control measures, wild dog traps, weed spraying – High risk detours due to track blockage – Remoteness from evacuation and medical assistance. – Lack of full coverage by mobile and satellite phones – Farm machinery, tractors, chainsaws, 4WD vehicles, pumps, farm and veterinarian chemicals, power tools, electric fences, open dams and water storages – Extreme events, bushfires, flooded rivers, snowstorms and blizzards, high winds, electrical storms and lightening strikes.
ALCOHOL AND DRUGS I understand the dangers of consuming alcohol or any mind altering drugs whilst riding or in remote camping situations and I will accept full responsibility for any injury or incident provoked or caused by my consumption of alcohol whilst on this adventure tour.
I AGREE to follow the directions given to me and that any misconduct or refusal by me to follow any direction can result in the CANCELLATION of participation in the activity and my immediate removal from my horse NO MATTER where that may occur. I understand that any such non-compliance may result in injury, death and/or permanent disability and I agree to indemnify the Releasees against all claims made by any person as a result of my failure to comply.
I ACKNOWLEDGE that the enjoyment and excitement of adventure activity is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and that these inherent risks contribute to such enjoyment and excitement, being a reason for my participation.
I AGREE that if I suffer injury or illness, Bogong Horseback Adventures can, at my cost, arrange medical treatment and emergency evacuation service as Bogong Horseback Adventures deems reasonably necessary for my safety and well-being.
IN ENTERING into this agreement I am not relying on any oral, written or visual representatives or statements by Bogong Horseback Adventures or its staff, or any other inducement or coercion to go on the adventure trip, hence only of my own free will.
I AGREE that this agreement shall be governed in all respects by and interpreted in accordance with the laws of the State of Victoria and/or the Commonwealth of Australia.
SCHEDULE 2 – WARNING UNDER THE FAIR TRADING ACT 1999
Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you—
• are rendered with due care and skill; and
• are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
• might reasonably be expected to achieve any result you have made known to the supplier.
Under section 32N of the Fair Trading Act 1999, the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.
NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence is defined in the Fair Trading (Recreational Services) Regulations 2004.
